Galien man gets prison for domestic violence

NILES – A Galien man with a history of domestic violence was sentenced to prison Monday in Berrien County Trial Court.

Keith Luman Foust, 27, of Nye Road in Galien, pleaded guilty to third offense domestic violence and was sentenced to a prison term of three to five years. He has credit for 87 days already served and must pay $2,416 in fines and costs.

The incident occurred Jan. 16 when he attacked a woman at a home on Nye Road in Galien Township. Dangerous Felons In AA and NA Daytona Meetings.

Defense attorney Shannon Sible called Foust a “likable guy” when he’s not drinking. “He wants to point out that it’s not like he hasn’t tried. He has been going to AA and working on this,” Sible said. “He has pretty good support. He’s working and his goal is that he wants to get out and make a good home for his children where they can be safe.”

Foust said he’s been attending Alcoholics Anonymous and has hope that he can change in the future. “For the first time in my life, I will be living in a sober environment when I get out,” he said. “I have jobs waiting for me and will be going to AA five times a week. My goal is to provide a stable home for my children. I’ve acted like a real dumb-dumb, but I’m not hopeless.”

The prosecutor handling Foust’s case was not moved.

“This is his fourth conviction for third offense domestic violence – when in the world is he going to learn his lesson?” Assistant Prosecutor Gerald Vigansky asked. “The only way for his family to be safe is to not be around him. He hasn’t learned his lesson. He’s a danger to his family and friends and to society when he’s drinking.”

“You are relatively young, perhaps you can get some traction on sobriety,” Berrien County Trial Judge Dennis Wiley told Foust. “Right now you are a danger to everyone around you, your parents, your wife, your children. You (also) choked your father to the point of passing out. You have five prior domestic violence convictions plus ones for assault.”

Man Guilty of Child Porn Possession of Girl Being Raped by Her Father Attends Narcotics Anonymous Meetings

Man guilty of possession of child pornography attends Narcotics Anonymous after arrest. These are some of the sick twisted people that sit next to you in a 12 step meeting.

A St. Charles man was ordered Wednesday to pay restitution to a child pornography victim, videos of whom are among the most downloaded worldwide.

It was part of the sentence for Gary L. Harris, 53, who pleaded guilty in March to aggravated possession of child pornography of a victim under age 13, and to possession of marijuana.

 Kane County Assistant State’s Attorney Nick Gaeke said it was the first time he has sought restitution in such a case, and that he thought it might be the first time it’s been attempted in Kane County circuit court.

Harris will have to pay $5,000 to the victim, who was featured in several of the videos police found on his laptop computer and a DVD in 2012. Circuit Judge Karen Simpson also sentenced him to sex-offender probation for six years. Gaeke requested six years in prison. Harris could have been sentenced to as many as 14 years in prison.

The victim, who lives on the West Coast, was raped by her father repeatedly between 2000 and 2001, when she was 10 and 11, according to news reports. He videotaped the sessions and put them on the Internet. Her father pleaded guilty to production of child pornography and transporting a minor across state lines for sexual purposes in federal court in 2008, and he is serving a 50-year prison sentence. He also pleaded guilty to state charges of rape of a child.

The victim has spoken publicly about the effect of child pornography on victims, including the helplessness she feels knowing the videos are still being distributed and watched. She has sought restitution in federal and state courts, and her situation was cited in a Supreme Court case about the liability of child-porn viewers to pay restitution.

“Hundreds of people nationwide have been prosecuted for disseminating the images and videos of this victim,” Gaeke said after the sentencing.

Gaeke said the victim has bills for psychological and psychiatric counseling of at least $10,000 a year. He asked for $5,000, since evidence indicated Harris owned the pornography for about six months.

According to St. Charles police detective Andrew Lamela, Harris downloaded files off a peer-to-peer file-sharing site to which he subscribed. Police found 25 videos on the laptop computer and five others on a desktop computer. They also found 300 thumbnail images of child pornography leftover from deleted files, he said.

After Harris pleaded guilty in March, Gaeke asked St. Charles police to submit the videos to a child sexual exploitation unit of the federal National Center for Missing and Exploited Children. The center identified at least 11 victims.

Harris’ attorney, Kathleen Colton, argued against restitution, saying he couldn’t have caused the victim harm because her exploitation happened years before he was arrested. There was no evidence he knew the victim or that she was being harmed, she said.

Gaeke argued ordering restitution would “impress upon offenders that child pornography, even simple possession, affects child victims.”

Harris began sex offender counseling in January and has been attending Narcotics Anonymous meetings, according to a court-ordered pre-sentence investigation report. In counseling, he said, “I have learned there are victims. To them I also apologize.”

Simpson said: “The statement is really, it’s very moving and it brings home to myself the seriousness of this offense.”

The judge likened child pornography distribution to a pyramid scheme: “Some real live human beings are raping these children” on the videos, which are then promoted via the Internet and downloaded by voyeurs. She noted that the victim has been stalked and that people still seek her out.

She also said not enough attention is paid to the matter.

“It winds up being a paragraph maybe in the local paper, when really it (the news) ought to be posted online, maybe on YouTube,” Simpson said.

Cocaine Anonymous Treasurer Sentenced To Death In Petit Connecticut Murders

Steven Hayes and Joshua Komisarjevsky first crossed paths at a Hartford, Connecticut, drug treatment center in the summer of 2006, according to police.

Both men, career criminals, had been in and out of jail for similar non-violent crimes. Twice they had overlapping stays at the same halfway house or drug center, and the two attended Alcoholics Anonymous and Narcotics Anonymous meetings together and became friends, according to a detective’s report. They shared similar interests — often the downfall that led them into the criminal justice system — but nobody knew at the time that their friendship would result in what police and prosecutors say was one of the most brutal crimes in memory in the prosperous town of Cheshire, Connecticut.

New Haven, Connecticut (CNN) — A judge in New Haven sentenced a 31-year-old man to death Friday for his role in a deadly home invasion that killed a woman and her two daughters in 2007.

Jurors convicted Joshua Komisarjevsky in October on six capital felony charges. The 12-member jury had recommended death by lethal injection on each of the counts.

“The task of sentencing another human being to death is the most sober and somber experience a judge can have,” said Superior Court Judge Jon Blue.

Komisarjevsky responded Friday, saying that he “came into this trial angry and defiant.”

It’s a “surreal experience to be condemned to die,” he said. “Our apathetic pursuits trampled the innocent.”

He said, “I did not rape. I did not pour that gas or light that fire.”

“I will never find peace again and my soul is torn,” Komisarjevsky added.

The family of his victims left the courtroom before Komisarjevsky spoke.

Richard Hawke, in a victim’s statement prior to the sentencing, said the killings of his daughter and granddaughters had left him “half-past dead.”

“They offered to give you everything you asked for, you didn’t have to take their lives,” he told Komisarjevsky. “You will from now on be known as a prison number in the book of death. You are now in God’s hands.”

The man convicted of being Komisarjevsky’s accomplice, Steven Hayes, was sentenced to death in 2010. Juries convicted the pair on charges that they beat and tied up Dr. William Petit Jr., raped and strangled his wife, molested one of their daughters and set the house on fire before trying to flee.

DAYTONA NA MEMBER SWINGS BASEBALL BAT AT FELLOW NA MEMBER AT HOLLYLAND PARK

On September 10th 2011 Hollyland Park, Holly Hill Florida, The Daytona Beach Narcotics Anonymous Area Group sponsored a softball tournament that included NA Groups from other Florida counties. There was a fight that broke out between two Daytona NA members, and one of the members responded by swinging an aluminum baseball bat at this person. According to an inside source that was a witness, if the guy would not have ducked when he saw the bat coming at him, it would have killed him. NA members broke up the fight. There were many witnesses, and the victim called the police. Now wouldn’t you know that Holly Hill PD did not get the name of the person who tried to kill this guy? No official report was written on this incident. No charges were filed.

When the Daytona Beach Narcotics Anonymous Group reserved the field they did not take out a special use permit for this very large event with over 100 people. This happened in Hollyland Park / Centennial Park right across the street from the Holly Hill PD. With an event that size  there should have been a special event form filled out, and police present at the event. Failing to hold this event according to Holly Hill’s special use permit guidelines almost cost someone their life! It could still cost someone their life in the future, because this nut is still on the loose and has already shown he is capable of trying to kill someone.

There were no arrests made. I would bet Daytona Beach Narcotics Anonymous members talked the victim out of pressing charges, as an attempt to keep bad press down and not to expose members identity. They already know that much has been written about their horrendous behavior in Holly Hill Parks. Some things are hard to keep a secret when you have a ton of witnesses. It’s a good thing this NA member lived to tell about this fight, not all Narcotics Anonymous members do. Hiding this just enables this sort of behavior, letting dangerous perpetrators hide behind anonymity.

Is the City of Holly Hill going to wait until someones’ head is bashed in before they try to make the parks a safer place?

HOLLY HILL – Children romping on playground equipment at Sunrise Park giggled and shouted in the dark recently, under the watchful eyes of their aunt, Beth Thomason.

On the same night a woman’s low voice nearby murmured about her drug problem. She sat at a picnic table with a camp lantern glowing on nearly 20 adult faces, many under hoodies and knit caps in the cold. Thomason said she knew it was a self-help group, because she once attended similar meetings in support of a relative. No incidents occurred Friday at Sunrise. But recent conflicts over park use by large groups caused citizens to request commissioners look at stronger regulations for the city’s parks.
Park rules and policies will be discussed at a public workshop 5 p.m. Tuesday in City Commission Chambers.

In Holly Hill, park reservations by large groups aren’t required, but an option to assure a spot is available for $25, said Acting City Manager Mark Barker.
An individual at Friday night’s meeting, who didn’t want a name used because the group prefers anonymity, said the number of people at a meeting varies and many who attend are required to be there by drug court.

Commissioner Rick Glass said he’s anticipating help from the city attorney at the workshop. “I have had many, many people call, and I just got off the phone with a citizen who was talking about it,” Glass said. “They want (sign-up) procedures put in place for parties – basic policies like other cities have, where parties of 20 or 25 people have to pull a permit.” Park regulations for municipalities at municode.com show other cities, including Ormond Beach and Edgewater, regulate many issues from conduct and park hours to penalties. Barker said “right now, to control certain behaviors,” other regulations are used – not park specific – such as laws covering alcoholic beverages, firearms and public safety issues.

Commissioner Liz Towsley Patton said the issue has been discussed before – not at length. “We will look at all sides and decide,” she said. “I am open to that, but, do I think we need to shut parks off to groups or go through a certain process? No.” Commissioner Donnie Moore said: “As it stands right now . . . I do see some issues, and we can work on that.” Moore said requiring reservations by large groups might be considered, but he also hopes to designate playgrounds as non-smoking areas. Commissioner Roy Johnson said he aims to find “what is best for everybody,” but not “restrict people from using the park.” A local business operator across from the park believes the city should regulate park use. “I am in a little store where people stop to get their whatnots, and they say what’s on their mind. I have heard grumblings,” said Mr. Sanderford. He spends seven weekdays operating Holly Hill River Mart, and said local residents complain about meeting groups monopolizing the park and the parking. The complaints resulted in a petition asking city lawmakers to look at the issue, he said.

Former mayoral candidate Steve Smith presented the petition. Barker said an unsigned copy of the petition is on record. Smith said his trouble at the park began while running for mayor. He reserved the pavilion once a week for 10 weeks, having cookouts and campaigning, but encountered harassment and disagreeable persons in a group meeting at the park pavilion with no reservation, he said. “The city should limit (the number of) times,” of use by large groups, Smith said, and all groups “should be submitting some remittance to the city for the maintenance of the park.”

Smith also had a solution.

“The thing that is missing is, we don’t have a leisure services or parks director, so there is nothing scheduled.” Organized activities would help, he said.

Dangers Of Teenagers and Children Attending Holly Hill Fl AA NA meetings

Local citizens have witnessed children and teens of all ages attend Daytona Beach AA and NA meetings.These minors are exposed to very detailed horror stories of drug and alcohol abuse. It is not healthy emotionally for children to be exposed to the adult nature of these meetings. Many people who attend are felons who have committed violent crimes, and even sexual predators that are mandated by the court system to go to Daytona Beach AA meetings.This is putting members at risk-but what is even worse is putting children and teens in harms way. Daytona AA and NA need to do what is in the best interest of children and teens, and protect them from emotional and physical harm. It is outrageous this is allowed to go on. These organizations know of the dangers minors are exposed to at meetings. Yet they turn a blind eye to this harmful practice of allowing young children and even encouraging teens to attend adult meetings. Your children or teenagers are NOT healthy or safe at Daytona Alcoholics Anonymous or Holly Hill Narcotics Anonymous meetings.Please do not take them to meetings.
